Terms and Conditions

These terms and conditions apply to the contract between us for the supply of goods ordered by you but do not affect any statutory rights you my have. Orders are only deemed to have been accepted once the goods have been despatched.

Terms and Conditions of Sale
Unless otherwise agreed all sales made by Windsors Catering Equipment (Birkenhead) Ltd ("The Company") are made on these conditions of sale. No variation of these conditions of sale or any terms supplied with any order form or other document provided by you will be binding on ("The Company") unless confirmed in writing by a Director of ("The Company") All goods are subject to availability. As a result of continuing product development the specification or design of goods may vary from that shown. You are responsible for deciding on the suitability of goods offered for any particular purpose and for the consequences arising for any work we undertake on the goods at your request.

1. Prices & Payment
All prices in our catalogue, leaflets and our website are in pounds sterling and were correct when published and given in good faith and are subject to VAT at the current rate. ("The Company") reserves the right to change the advertised price before you place an order. Unless otherwise agreed payment is required prior to delivery of the goods. Where ("The Company") agrees to issue an invoice you must pay the invoice within 30 days of the invoice date. For so long as any amount to be paid for goods remains owing to ("The Company"), title of goods will remain with ("The Company") and will not pass to you until ("The Company") has received full payment including any interest due. ("The Company") may charge interest at 4% above the base rate from time to time of HSBC Bank Plc on any amount not received by the due date until such amount is received, both before and after judgement.
 
2. Delivery
The majority of goods are usually delivered within 3-5 days on the UK mainland, although bulky or fragile items may take longer. Ask for details for deliveries outside of the UK mainland. Risk of loss or damage to goods shall pass to you upon delivery. Claims for damage to goods must be noted at the time of delivery and notified to ("The Company") in writing within 24 hours of delivery to you. Claims for non-delivery of goods must be notified to ("The Company") in writing within 7 days of the invoice date. Goods returned will be accepted entirely at ("The Company") discretion, within 7 days of delivery to you providing that they are unused, in perfect condition and in their original packing. Under the Distance Selling Regulations 2000 (DSR2000) you have the right to return your goods, (applies to UK mainland only) and also applies only to ("The Company") stocked product lines, provided you do so at your own cost and within 7 working days from the day after you received and signed for the goods. There will be a 25% re-stocking charge for goods returned to the manufacturers. If you wish to cancel an order after it has been dispatched you may have to pay round trip delivery costs and the 25% re-stocking charge. You must contact us to obtain authorisation to return goods on our Customer Services Returns line on 0151 666 1077. Any goods returned to ("The Company") without authorisation or not in the condition set out above will be rejected and returned to you at your cost. ("The Company") reserves the right to charge an administration charge on all returns. Where goods do not appear in a ("The Company") publication (including but not limited to our catalogue, or a leaflet, or our website) and are specially ordered for you, ("The Company") will only accept return of the goods if they are defective and returned within 14 days of delivery by you. This also applies to goods that have been embroidered and goods that have been engraved. Delivery will usually be made to the door (or site) but unless otherwise agreed not to locations within. Installation is not included unless otherwise agreed. You must make sure that you have sufficient handling facilities to receive the goods you have ordered and that any large or bulky items can fit through the required access. Any charges incurred from an unsuccessful delivery attempt by the carrier must be paid for by the customer as recipient.

3. Guarantee & Liability
Goods supplied by ("The Company") are guaranteed in accordance with the terms of the manufacturer's warranty provided with the goods or for 1 year if not stated with the goods. The warranty applies to UK mainland only. If any of ("The Company") products proves defective within 1 year of purchase we will repair it at no cost to you. Our warranty does not apply to wear and tear, or if a product has been damaged or misused.

Machines returned for repair in warranty where it is found that the machines has been abused or has not been used as the machine was designed for will be charged for. This also applies where a machine has not been properly maintained including cleaning and descaling where applicable. Machines returned for repair are not reassembled if upon quotation you do not require the machine to be repaired. Loan machines are not available. ("The Company") accepts no liability of whatever nature arising from as a result of any representations, breach of contracts, late delivery of product, negligence or otherwise including but not limited to any liability for indirect or consequential loss, or loss of profits, revenue, business or goodwill except for liability of death or personal injury caused by ("The Company") negligence. All conditions, warranties, guarantees and representations, express or implied, by statute, common law or otherwise in relation to the goods (other than the liability which ("The Company") is not permitted by law to exclude or restrict) are hereby excluded.

Every effort will be made by us to handle service calls quickly, however the manufacturer will dictate the service arrangements. It may not be possible for service calls to be made on weekends, bank or public holidays, evenings or at a time the customer specifies.

If a service call is requested during the guarantee period and the fault lies with the operation or installation and not the equipment itself then the charge for the service call will be payable by the customer.

Any warranty cards must be returned to the manufacturer duly completed.

("The Company") is not liable for any consequential loss or damage of any sort.

If any person undertakes the supply and/or fitting of parts not specified by the manufacturer, then any guarantee for that product may be void.

4. Installation
Installation is not included unless agreed in writing. The customer agrees to indemnify ("The Company") against claims for defects caused to equipment by faulty or inadequate installation.

All gas appliances must be installed by a Gas Safe registered catering engineer as required by law, and a certificate of installation should be made available to the supplier on request. All electrical equipment must be installed by a suitably qualified engineer and a certificate of installation should be made available to the supplier on requests.

Any equipment which is required to be connected to the mains water supply should be installed by a suitably qualified engineer and a certificate of installation should be made available to the supplier on request.

Water softeners must be installed according to the manufacturerÂ’s recommendations or the products guarantee may be invalidated.

5. Status
("The Company") may at its absolute discretion decline to accept orders or to offer credit terms. Placing an order with ("The Company") is taken as authorising us to approach a credit agency on the details given. All errors and omissions excepted. All trademarks acknowledged.
